Charles Henry Eckert & Mary Lucy Post

Charles' Naturalisation Papers (1889) state he was from Oberstenfeld, Wurttemberg (Germany), and that he arrived aboard the Northumberland in Victoria on 4Dec1877, and travelled by coastal steamer to NSW, arriving on 24Dec1877. His death certificate puts his birth year at about 1850; and I have found a record of a Carl Heinrich Eckert, born 8Apr1850, Oberstenfeld,Wuerttemberg; parents: Christian Friedrich ECKERT & Dorothea Catharina NESTEL
Extract from Albert Grulke's Kinder des Vaterlandes
The majority of German settlers seem to have come north form the Hunter Valley. Some came down from Moreton Bay but others like the Baumgartner, Hamell and Eckert families arrived in Grafton. When their contracts finished they crossed the range to settle at Saumarez Ponds near Armidale. They were brought to Australia under the Bounty Scheme and contracted by Wilhelm Kirschner in Württemberg.
Those who had come out on the Bounty Scheme still had debt to pay. This was achieved within a few short years because of the diligence and determination found in the German character. Once the debt was paid they purchased land for themselves. They then worked and developed their own land while working part time for the large landholders."
Mary was born in 1860 at Kellys Plains near Armidale, NSW. Mary's parents, George and Katherine (Maurer) Post were from Eltville, Nassau (Germany). They arrived in Australia aboard the Parland on 5Jul1849. Mary's mother died when Mary was just 6 years old.
George Post receives the following unflattering reference in Colonial Armidale by John Perry (University of Queensland Press, Brisbane, 1999).
At the other extreme was George Post, a German immigrant from the village of Eltville in Hesse Nassau, who married his second wife, Catherine, in 1870 a few years after his first wife had died in childbirth, prematurely induced by a severe beating at the hands of her husband. When George Post died in 1875 his brief death bed Will left everything to his children making no mention whatsoever of his wife.
Charles and Mary were married 10Apr1882 at Armidale. They already had one child at this time; Martin Alexander Eckert, born 5Jan1882 at Armidale.

Gravestone, Barraba Cemetary - Charles Henry and Mary Lucy Eckert
Court case
From the Sydney Morning Herald 23Jun1936:
Alexander v Eckert and another.
This was a claim for £100, said to be due under a contract for the sale of sheep. Counsel for plaintiff said that Charles Henry Eckert, deceased, had been a grazier and owner of a property known as Retreat. He had 12 children, and in 1925 had come to live in Sydney with a married daughter. About March, 1928, he had transferred Retreat to two sons, with the exception of furniture and the sheep. It had been arranged that the sons were to buy the sheep for £1000 and pay £100 a year.
Defendants denied that the contract was for £1000, and said that it was agreed that the purchase price of the sheep should be £800, but that the payments would be waived if the father died before they had been completed. The father died in 1934.
The case is part heard.
Mr. Lytton Wright (instructed by Percy Williamson and Co.) appeared for the plaintiff, Alexander; Mr. Young (instructed by Whitehead and Ferranti, Sydney Agents for Ryan and Ryan, Tamworth) represented defendents.
n.b. The sons would have been Harold and John, and the married daughter was Sophia, and her husband James Alexander.
From the Sydney Morning Herald 24Jun1936:
Alexander v Eckert and another.
A verdict for the amount claimed, £100, was returned in this case, which was continued from yesterday. The claim related to payment for sheep, said to have been sold on the understanding that £100 would be paid every year off the purchase price.
Mr. Lytton Wright (instructed by Percy Williamson and Co.) appeared for the plaintiff, Alexander; Mr. Young (instructed by Whitehead and Ferranti, Sydney Agents for Ryan and Ryan, Tamworth) represented defendents.
Why were the Alexanders getting the money? Perhaps they were acting on behalf of Mary and the money went to her; perhaps there was an arrangement that the yearly payments went to them in exchange for looking after Charles and Mary. What lasting effect did this dispute have between the family members?
